What is the Heartbeat Bill Exactly?

SB 8 requires an abortionist to use an invasive medical practice to detect the fetus’ heartbeat before an elective abortion. If the heartbeat is detected, then the abortion is prohibited (hopefully not for long). A heartbeat is generally detectable around six weeks of gestation. Generally this is before many women know that they are even pregnant, making it difficult to obtain what is often a necessary and important medical procedure.

If the doctor is acting in bad faith or does not properly document the method and results of the heartbeat detection the law (which we hope is repealed soon) is violated. Individuals who aid or abet what is a perfectly legal medical procedure according the the US Federal Law but that Texas is attempting to block can also be sued under SB 8.

SB 8 is unique since enforcement is illegal federally and the state wants Texans to enforce it on each other so that they are not held responsible for enforcing religious laws. The Texas Heartbeat Act calls upon citizens to hold doctors accountable to following the law. Any Texan can bring a lawsuit against a doctor or someone aiding and abetting a woman having a medical procedure after six weeks. If these individuals are proved to be violating the law, they have to pay a fine of at least $10,000.

Why is this a civil lawsuit and not a criminal charge? Again the legislature knows and understands that they are attempting to circumvent the Supreme Court Ruling commonly known as Roe v Wade and rather than face the actual law, they are hoping that Texans will turn on each other in these desperate times. They have underestimated the strength, love and tenacity of Texans.

Medical Abortions

 

These pills are generally used if you are less than around 10 weeks pregnant. Two different pills are taken, often 36-48 hours apart, but some providers will give you both at the same time.
